Canany <br />Division Director <br />Natural Resource Trustee <br />The Division received the second adequacy response prepared by Banks & Gesso, LLC. for <br />Technical Revision (TR-OZ) for the Lyons Quarry, Permit No. M-1977-208. The operator has <br />changed the location of the proposed disposal cell so as to not impact the Smead Ditch. In addition, <br />the plan involves a diversion ditch to be constructed azound the entire azea of the disposal cell with <br />a riprap pad at the ditch terminus. <br />The Division requests further information regarding the riprap ditch terminus pad. Please describe <br />in writing the intent of the riprap pad, and the estimated volume of water to be diverted to this <br />structure. If ponding of water is expected, please explain how and where the water will be <br />dischazged. Please also state if the revised diversion ditch intends to divert any water from existing <br />or natural drainages in the area. <br />The Division's decision due date was extended by CEMEX to September 5, 2003. If you feel more <br />time is needed to complete your reply, the Division can grant an extension to the decision date. <br />This will be done upon receipt of a written waiver of your right to a decision by September 5, 2003 <br />and request for additional time.
