In this case, this is considered the property of EI Paso County. There are two <br />ways that this property is covered. If a road is built on the right-of-way and accepted <br />as a county maintained roadway, then a deed will be filed and ownership given to <br />that county. If a road does not exist, then the right-of-way is considered county <br />property by statute as declared in the resolutions and a future right-of-way. <br />In addition, we have researched the legal descriptions for all of the adjacent <br />properties to the right-of-way in question. You will see that all of these descriptions <br />start with a 30-foot setback from the section line in order to allow for the right-of-way. <br />I have included the legal descriptions on these adjacent properties for your review. <br />Please note that the legal descriptions of all the adjacent properties are along the <br />county right-of-way of Washington Rd with no other owner reservations are involved. <br />Also please note that there is not an access easement reserved by Bronco Ranch <br />Homeowners Association. <br />We have also taken the time to research whether or not the Bronco Ranch <br />Homeowners' Association owns any real property within EI Paso County. After <br />searching the tax accessor's website, the county clerk and recorders website, and <br />visiting their offices as well as the county treasurer's office, we are confident that <br />there are no recorded deeds for property owned by them at any location in EI Paso <br />County.
