Long <br />Division Direc mr <br />Per your request, I have reviewed MR-83 submitted by Colorado Yampa <br />Coal Company to revise their success standards for vegetative <br />production on pastureland. The revision clarifies the success <br />standard so that it matches the sampling methodology currently <br />employed by CYCC and previously approved by the Division. The <br />revision can be approved as submitted. <br />For your information, prior to this change the success standard for <br />pastureland stated that "no single species" would exceed 75$ <br />relative production. However, the sampling was being conducted via <br />the approved plan, which was by "lifeform" plus alfalfa. This <br />meant that each species was not being sampled separately (except <br />alfalfa) and, therefore, it was not possible to prove if a single <br />species (except alfalfa) was exceeding 75~. Since preventing <br />alfalfa from exceeding 75~ of relative production was the actual <br />goal of this success standard, MR-83 was submitted to specifically <br />state that and remove any ambiguity that could have resulted from <br />the way it was stated. <br />If you have any questions, please see me. <br />cc: David Berry <br />
