Long, <br />Diwsian Director <br />RE: Vagreur Site (Permit M-80-085) FAX Received 6/29/92 Regarding Division's <br />Adecuacy Review of TR-08 <br />Dear Ms. Wilson: <br />The Division is in receipt of your FAX letter referenced above which is dated <br />June 22, 1992 but received in our office June 29, 1992. <br />The Division can accept your argument that adequate bond is in place to cover <br />reclamation of the Employee Housing area i` you will also amend your approved <br />mining plan with this proposed Technical Revision to specify the 40 acres <br />currently bonded that will not be affected by the mining operation. Exhibit D <br />of Elam's permi~~application indicates that ". the affected land, for <br />purposes of this permit application, is to be the entire 104.72 acres." Based <br />on this, the Division originally required the existing 3105,000.00 reclamation <br />bond. <br />If you are overbonded to such a degree as a result of a change in your mining <br />plan, it might be to your advantage to seek a bond reduction. A bond <br />reduction, however, must be requested as an action separate from this <br />Technical Revision. <br />In addition to supplying the requested amendment to your revision, if that <br />submittal cannot be made in time for the Division to consider approval of <br />TR-08 by July 1, 1992, you must waive your right to a decision on the revision <br />by that date. Otherwise, the Division will, in the absence of evidence of <br />adequate bonding, be required to deny proposed TR-08. <br />If you have any questions on the above, please call. <br />Sincerely, <br />' i <br />James C.
