Hox AA <br />Hayden, Co. 81639 <br />Dear Bill, <br />The Division is proposing a decision t o approve with stipulations your <br />technical revision for the haul road to Pit No. 4. Subject to acceptance <br />of the stipulations on your part and any comments or protest resulting <br />from the public comment period, you may begin construction of the road <br />ten days after publication of the proposed decision, We will require <br />proof o= publication from the newspaper. <br />The following stipulations are proposed as conditions of the approval <br />of the technical revision: . <br />I) The construction of the haul road must be certified by the design <br />ergireer (Mr. Michael L. Brown, Colorado Registered Professional <br />Engineer No. 11017, of Hydro Triad Ltd.). This will require his <br />periodic inspection and supervision during construction of the <br />haul road. Any changes in allignment or grade necessitated by <br />field conditions should be documented in the "as-built" plans <br />submitted as a portion of his certification statement. He should <br />certify that the road, as constructed, conforms with the assump- <br />tions used in completing his stability analysis. <br />2) Topsoiling and reclamation of the road must not occur until <br />after mining and at which time the road is no Longer used to <br />haul coal. Topsoil must be stockpiled, seeded, and bermed to <br />prevent topsoil loss through erosion. The cut and fill slopes <br />along the road must be temporary seeded for stabilization. <br />Crested wheatgrass and smooth brome must be removed from the <br />seed mixture. <br /> <br />In addition, our staff will inspect the construction of the haul road <br />during our required inspection visits. During these times an assessment <br />will be made of the characteristics of the fill material and it will be <br />verified that appropriate construction techniques are being used. The <br />stability determinations are not valid if the fill material or construction <br />techniques vary significantly from assumed conditions of the analysis.. <br />
