(BMRI) hereby
withdraws Technical Revision (TR) 28 for the San Luis Project. As referenced ih Mr. Bruce T.
Mazshall, of Rocky Mountain Consultants, Inc.'s, correspondence dated April 20, 2000 to Ms.
Lori Potter, "The West Pit Water Management System has not operated through a complete
hydrologic cycle, nor has the in-situ remediation system been tested. Therefore, we believe it is
premature for the Division of Minerals and Geology (DMG) to have requestrrd that BMRI
develop such a plan" (see page 1, paragraph 2, second and third sentences). BMIRI agrees with
Mr. Marshall's conclusion that the plan is premature and, therefore, withdraws TR-28.
As BMRI committed to in TR-26, BMRI will "submit a detailed plan for post-closure water
quality *nonitcrsng ir. the alluvial systcm" at a later date as directed by the Divisicn.
