The application was received on May 18, 2001 and determined w be complete for technical <br />review on June I8, 2001. An Adequacy Letter was sent to you on August 14, ?001, and this letter addresses <br />items that require clarification in your response received September 10, 2001. The decision datr for this <br />application is September 17, 2001. Please be advised that if you are unable to satisfactoril~~ addrrss the <br />concerns identified in this review prior to the decision date, it will be your responsibility to request an <br />extension of the review period. IF there are outstanding issues that have not been adequately addresed prior <br />to the end of the review period, and no extension has been requested, the Division will deny !Ilis application. <br />The following items require further information or clarification: <br />~rmit Application, PaEe 2, Item 9, Location information: The Township has been changed from v <br />[he correct location on the original application (T 34 S) to Township 34 North Dn this revision. Please <br />re-submit this page with the correct township and range directions. Additionally, in the quarter <br />section the box for NW and SW have been checked. The instructions ask that one box be checked. It <br />is this inspector's understanding that the permit is for the SW i/a of Section 8 so the box for SW <br />should be checked and NW ahouid ire left blank. Iu the Quarter iluaiter section both Nvv and S'H' <br />have been checked. The instructions ask that one box be checked. As the permit is apparently for the <br />mire SW i/a, there is no need to check either of these blanks. A marked-up copy is provided in the <br />merest of clarification. Please correct this sheet and re-submit it. <br />6.4.1 Exhibit A Legal Description: The legal description submitted in the original submittal as <br />Exhibit A, appears to represent the area being proposed to be mined. The new Exhibit A received in <br />this office on September 10, 2001 describes an 80 acre parcel. The application indicates the permit <br />area to be 160 acres. Please indicate in a revised submittal what area you wish to permit. This area <br />must agree with the various maps and with Exhibit N, Source of Legal Right to Enter. Please call me <br />and I will be happy to assist in the description.. A marked-up copy is provided in the interest of <br />clarification. Please cotrect this sheet and re-submit it. It appears that the correct description would <br />be: the Southwest '/a of Section 8, Township 34 South, Range 48 Wes[ of the Sixth Principle <br />Meridian, consisting of approximately 160 acres. <br />
