Walther <br />Executive Director <br />Ronald W. Cattany <br />Division Director <br />The Division received additional correspondence from you on April 14, 2003. You made several <br />comments and reiterated your concerns and objections regazding the referenced amendment <br />application. I will attempt to address your concerns as best as I can. <br />First, the Division of Minerals and Geology does not regulate local land issues and has no idea <br />what the County policy is towazds accepting or refusing any type of mail. If you feel you have <br />been discriminated against I would suggest you contact your county officials and discuss your <br />problem. <br />Second, yes your land does abut the south side of the proposed affected land boundazy. That is <br />the reason you received notice of the amendment application. The Division received a copy of` a <br />signed certified letter return receipt which was signed by you on Mazch 14, 2003. <br />Third, most of the reclamation permits that aze issued aze "Life of the Mine" permits. The term is <br />set by statute; C.R.S. 34-32.5-103(11). <br />Fourth, public notice was published in the Canon City Daily Record for four consecutive weeks <br />beginning on Febtuazy 26, 2003 with final publication on Mazch 19, 2003. The publication <br />complied with state requirements. Anyone from Canon City or Florence that read the notice <br />would have been aware of the proposed application. <br />Fifth, you will need to ask Rocky Mountain Materials & Asphalt if the proposed mining <br />operation equates to creating jobs. Also, there are other agencies that regulate pollution (dust, <br />noise, etc.) and Rocky Mountain will deal with those agencies if they have a pollution problem. <br />The DMG does have jurisdiction over potential groundwater problems (SB-181) <br />Sixth, it is a personal decision for all those who are moving in or out of Canon City and Florence <br />and a local issue, most likely handled by the municipalities. <br />Seventh, you aze correct, a life of mine operation is not a "one-or-two-day operation." By statute, <br />the permit is granted for a term as defined in C.R.S.34-32.5-103(11) <br />
