Custom mills require a Certificate of Designa-
tion under the SWDFA, and do not need a Mined Land Reclamation
Board permit. Even if the mill takes waste from only a single
ofF-site source, the mill requires a Cb. If a mill ceases taking
oPE-site wastes, the mill may continue operations under the Cb,
ar may, at its option, apply for a Mined Land permit, and abandon
the CD. CDH intends to define "custom mill" by regulation.
3. Soap Leaching Operation. Facilities conducting heap leaching
do not require a CD, buk simply a Mined Land Permit. Hived Land
in :its permit process will ensure that the substantive standards
of the SWDFA are complied with in the disposal of the heap leach-
ing waste on-site. Such disposal is the disposal of one'9 own
waste on one's own property, and does not require a CD, but does
require compliance with the substantive standards of the SWDFA.
IP a facility heap leaches materials which were imported from
off-site, and the other site has a Mined Land permit, the
Facility's heap leaching is simply the processing of purchased
raw material. Accordingly, no Certificate of Designation is
required.
d. Mined Land permitted areas used as landfills after mining is
completed. zE the landfill receives only waste from the mined
facility, no CD is required, since the filling is the disposal of
one's own waste on one's own property. Mined Land in its permit-
ting wizl ensure that the substantive standards of the SWDFA are
complied with.
If the landfill accepts wastes from off site, a CD is necessary.
Once a Landfill operator demonstrates that a CD to use the per-
mitted area as landfill has been issued, MLRa may choose to
release the operator Prom the MLRS permit and bond.
Oave elt~'on, Di[ector
Colorado Department of Healtri
Hazardous Materials b Waste
Management Division
Mir eel Long, lliteCtor
Mined Land Reclamation
Division
AG File No. DNR9201Z69.KJ
