Cattany <br />Division Director <br />Natural Resource Trustee <br />The Colorado Division of Minerals and Geology (Division) has finished its review of the Bowie <br />Resources Limited (BRL) application for Succession of Operator No. 2 (SO-2) for the Bowie No. <br />2 Mine. The Division has the following questions and comments: <br />Rule 2.03.4 <br />1. In BRL's reply to Rule 2.03.4(6)(a), on revised page 2.03-9, Bowie Resources, LLC is the <br />only entity listed as owning land that is affected by surface operations and facilities. If <br />there aze lands that contain facilities such as gob vent boreholes, exploration holes within <br />the permit area and roads, please list those surface owners as well. It would appear that <br />the Bureau of Land Management, the USDA-Forest Service and the Union Pacific <br />Railroad should be included in this section. <br />As a part of the permit renewal process, the Division needs to contact all surface and <br />mineral owners of the affected land within the permit azea, as required under Rule <br />2.08.5(3)(b). As a matter of convention, the Division contacts all surface and subsurface <br />owners within the permit area. The names and addresses for all of these owners are taken <br />from the operator's responses to Rule 2.03.4(6)(a). Therefore, please include in your <br />response to Rule 2.03.4(6)(a), all of the surface owners within the permit azea, regazdless <br />of whether or not the land has been affected by surface operations. <br />2. For Rule 2.03.4(6)(a}, on revised page 2.03-9, Bowie Resources, LLC is the only listed <br />owner of the coal to be mined.
