<br />DEVELOPMENT AND EXTRACTION MINING PERMIT
<br />THIS PERMIT is .issued this g day of November, 1978 by the Mined Land
<br />Reclamation Board, Department of Natural Resources, ~tata of Colorado.,,
<br />W I T N E S S E T H
<br />WkiEREAS, Beaver Brothers, Inc. desires to conduct a(n) open mining
<br />operation, known as MOON PIT lit , for the p'urpoae of extracting open
<br />mined sand S gravel and
<br />WHEREAS, on November 29. 19 78, Beaver Brothers, Inc. '~l?ILED" an appli•
<br />cation, a reclamation plan and map, and the required fee, as required b;r law; and
<br />WHEREAS, on Juge~28 , 1978 , the Mined Land Reclamation Board approved
<br />Beaver Brothers, Inc. application and set bond; and
<br />WHERY;AS, on November 8 , 19 7g, the Mined Land Reclamation Board accepted surety
<br />submitted by Beaver Brothers, Inc. and !uch date shall be considered the
<br />dace of issuance of the permit and the anniversary date for all other purposes; and
<br />WHEREAS, the Mined Land Reclamation Board has made a finding, for the purpwp
<br />of issuing thin permit, that:
<br />1) the application complies with the requirements of the Colorado
<br />Mined Land Reclamation Act and all applicable local, state and
<br />Federal lays; and,
<br />2) the operacioa will not adversely affect the stability of say
<br />signiEicane, valuable, and permanent man-made atzucturaa located
<br />within two hundred feet of the affected land, except where there
<br />Ss an agreement between the operator and the peraoae having ar.
<br />interest in the structure that damage to the structure Sa to be
<br />compensated for by the operator; and,
<br />3) the proposed mining operations and reclamation caa be carried out
<br />in conforaance with the require eats of C.R.S. 1473, 34-32-1.16,
<br />as amended (1976 Seaa. Laws H.B. 1065); and
