This technical revision requested an <br />incidental permit boundary change, which will be partially disturbed to allow for <br />construction of a deadhead route for the 650 dragline to walk from the Seneca II Mine to <br />the Yoast mining area. <br />Mr. Altavilla has advised me that you have requested evidence that the landowners whose <br />property will be affected by movement of the 650 dragline have been informed of the <br />scope of the project and are in agreement with same. <br />Enclosed herewith for your reference is a copy of the Memorandum Agreement for Right- <br />of-Way Easement dated May 17, 1996 obtained by Seneca Coal Company (SCC) through <br />good faith negotiations with Maneotis Sheep Company granting SCC the right to <br />construct, use, and reclaim a roadway for the transportation of mining equipment over and <br />across the subject property. <br />If SCC is required to provide any further evidence of its right to enter the property for <br />such purpose, kindly provide the statute or regulation setting forth such requirement and <br />SCC will use its best efforts to comply with same. <br />Seneca Coal Company • 1300 South Yale Street • Flagstaff, Arizona 86001 <br />Telephone (520) 774-5253 • Fax (520) 773-4596 <br />
