Said building was erected upon the Incas Mine site by our former Lessee and <br />operator in accordance with requirements of the La Plata County Planning and Building <br />Departments. <br />I refer to your letter dated October 31, 2002 to Jim Bender under the subject of Onsite Structures <br />where you discussed this building and stated "We agree that the plan should be changed, and the <br />actual building will not need to be removed." <br />I enclose for your information a copy of a letter dated July 17, 2003 addressed to Jim Bender <br />from Nancy D. Lauro, La Plata County Planning Director wherein she indicates that neither the <br />County Planning Department nor the County Building Director have any "concern with a <br />revision to your Mining permit to consider the structure permanent. "' <br />As the Owner and Lessor of the Incas Mines properties it is our intent and desire that the mill <br />building remains upon the site subsequent to conclusion of mining operations. We encourage <br />your approval of a revision of the permit to accomplish this change. Please provide us with <br />copies of your documentation regarding this permit, as we discussed when I was in your office <br />on Ju ~e 3, 2003.
