Notice of Proposed Decision <br />The Colorado Division of Reclamation, Mining and Safety (Division) has issued a proposed <br />decision to terminate jurisdiction for the privately owned lands within the former Coal Basin <br />Mine permit boundary, revoked Permit No. C-1981-017. The areas included in this decision are <br />located 4 miles west of Redstone in Pitkin County, Colorado as described below: <br />Township 10 South, Range 89 West of the Sixth Principal Meridian <br />SEC l0: E2SE4SE4, NW4SE4SE4, NE4SE4, W25W4SE4NE4, <br />E2SW4SW4NE4, E2NW4SE4, E2W2NW4SE4, S2S2S2SW4, S2S2SW4SE4, <br />SW4SE4SE4, SE4SW4NE4 <br />SEC i l: SW4NW4SW4, S2SW4 <br />SEC 14: NW4NE4NW4, N2NW4NW4 <br />SEC 15: NE4NE4NE4, NW4NE4NE4, N2NW4NE4, N2SW4NE4NE4, NE4NW4, <br />N2NW4NW4, NE4NE4, N2S2NW4NE4, N2S2NW4NW4 <br />The Coal Basin Mine is a formerly permitted mining operation. The operator of the mine, Mid- <br />Continent Resources declared bankruptcy in 1992. Subsequently, the Colorado Mined Land <br />Reclamation Board revoked the operating permit, and forfeited the reclamation bond in 1993. As <br />a result of these actions, the Division assumed the task of accomplishing reclamation of the site in <br />1994, as provided for in the Colorado Surface Mining Control and Reclamation Act. <br />Reclamation on the private property previously owned by MidCon Realty, LLC was completed <br />by the Division consistent with the statutory reclamation requirements of the Act and in <br />accordance with a Settlement Ageement under the jurisdiction of Pitkin County District Court. <br />The reclamation work was completed under the Settlement Agreement. Notice of Termination of <br />Reclamation Obligation was recorded with the Pitkin County Clerk and Recorder's Office on <br />March 6, 2002. No additional reclamation tasks have been undertaken by the Division on that <br />property. No bond money remains for any additional work at this site. This proposed decision <br />terminates all of the Division's involvement for the private lands within the former Coal Basin <br />Mine permit area. <br />Copies of the proposed decision aze on file for public inspection at the Colorado Division of <br />Reclamation, Mining and Safety, Room 215, Centennial Building, 1313 Sherman Street, Denver, <br />Colorado 80203, and at the County Clerk's Office in Pitkin County, 506 Main Street, Aspen 81611. <br />Any person who has an interest that is, or may be, adversely affected may request an adjudicatory <br />hearing regarding this proposed decision. Requests for a hearing must be made in writing within <br />thirty (30) days of the first publication of this notice, and shall state with reasonable specificity the <br />reasons for the request and objections to the proposed decision. <br />
