(Page 2) <br />MINE ID # OR PROSPECTING ID # M-1992-116 <br />INSPECTION DATE 2/22/05 <br />OBSERVATIONS <br />INSPECTOR'S INITIALS WHE <br />This inspection of the Ewing Mesa Pit No. 1 occurred as part of DMG's review of a request for reduction <br />in permit acreage and amount of financial warranty (SL-02) for the overlapping coal permit, Carbon <br />Junction Coal Mine, C-1992-080. The Ewing Mesa Pit No. 1 is approved for 64.51 acres affected land. <br />All but approximately 2 acres of the 64.51-acre permit area are redundantly permitted and regulated <br />under the Carbon Junction permit. Affected lands will be reclaimed to support industrial, commercial and <br />residential post-mining land use. DMG holds $322,197 financial warranty. Operations appeared dormant <br />during the time of this inspection. Two maps and seven photos accompany this report. <br />Mine identification sign was posted at the mine entrance. However, affected area boundary markers, <br />required under Rule 3.1.12(2}(b), were not posted along the southwestern end of the permit, adjacent to <br />the OVB stockpile. <br />Under SL-02, the coal permit holder has requested reduction of the coal permit area by 64.51 acres, <br />because such acreage have been incorporated into the Ewing Mesa permit. However, close review of <br />the maps submitted with SL-02 indicate an approximate 2 acre discrepancy between the boundary of <br />lands addressed under SL-02 and those permitted under M-1992-116. The acreage discrepancies, <br />illustrated on the enclosed Map A and B, will be addressed by the coal permit holder. However, some of <br />the acreage addressed under SL-02, and located within the Ewing Mesa permit boundary, contains coal <br />related equipment that is not addressed under the Ewing Mesa reclamation plan and financial warranty. <br />The coal related equipment and associated affected lands are shown in Photos 1 through 5c, The circled <br />numbers on Map B, correlate with the photos and show the approximate location of the equipment in the <br />photos.
