C-81-010 <br />Dear Mr. Humphries: <br />Rule 2.07.4(b) of our regulations requires that the Division shall issue a <br />proposed decision, granting or denying the permit, in whole or in part, within <br />120 days of the filing of the application. There is also a provision fora 60 <br />day extension which has been granted to Trapper Mining, Inc. The end of the <br />180 day period for your Permit Revision No. 2 is August 31, 1987. <br />Because the Division has not yet received all of your responses to the <br />preliminary adequacy review, the Division will be unable to review the <br />responses and prepare the documentation required for permit approval by <br />August 31 , 1987 <br />There are two alternatives remaining. <br />1. The Division can deny your application at this time and you can <br />re-apply. <br />2. The Division will continue to process your application if Trapper <br />Mining, Inc, agrees to waive your administrative right to-a <br />decision within the required 180 days. <br />A letter waiving your right to a period decision by the 180th day must be <br />submitted. <br />The Division would appreciate a response from you, indicating which operation <br />you prefer, by August 31, 1987. <br />If you wish to discuss this matter, please contact me or (•tike Long. <br />Sincerely, <br />Gregg R.
