The technical revision is necessary to complete the corrective action as
required in item No. 3 of the cease and desist order attached to Notice of Violation M-95-
031, dated March 29, 1995.
The technical revision entails extending portions of [he wester permit boundary
approximately 1.4 acres. The extension is necessary because topsoil stripped from mining
areas was inadvertently stock piled outside of the original permit boundary. The area
directly affected by the stockpile is approximately 0.96 acres. The proposed 1.4 acre
extension, as shown on the attached drawings, will provide an adequate buffer zone
between the stockpile and permit boundary. The extension will increase [he permitted area
from 50.68 acres to 52.1 1 acres.
Topsoil vas also inadvertently stockpiled outside of the permit boundary in the southwest
comer of the site, affecting approximately 0.07 acres. The topsoil at this location will be
removed and the area reseeded.
The technical revision will have no impact on the mining plan currently in effect. The
mine reclamation plan will be the same «~th the exception of a slight increase in area to be
reclaimed.
Items contained in the techmical revision are: revised legal description, revised pre-mining
plan, mining plan and reclamation plan maps, revised reclamation costs, revised "Owners
Of Record Of Affected Land And Owners Of Substance To Be Mined" statement, and
permission for use of the land from the Fountain Valley Authority.
404 West Fontanero Street • TEL 719636-5641 FAX 719-633-8475
Mailing Address: Post Office Box 1103, Mail Code 1260 • Colorado Springs, Colorado 80947-1260
COLORADO SPRINGS UTILITIES
