tnay be required to obtain additional permits avd approvals as a condition to the conduct of <br />the described activities on the Leased Premises, LESSOR agrees to make any necessary <br />applications, in LESSOR'S own name or with LESSEE, as may be required to obtain such <br />approvals. LESSOR agrees to execute all documents and agreements which may be required <br />of LESSOR as a condition to obtaining such approvals and to fully cooperate with LESSEE <br />in connection therewith. <br />(c) Upon LESSEE'S exercise the Option as provided in Paragraph 3, LESSEE <br />may conduct any permitted activities allowed under temporary permits or approvals issued <br />by goverunental authorities. <br />(d) All costs, fees and charges which shall be incurred or required in connection <br />with obtaining any such approvals under this paragraph 12 shall be the sole obligation of <br />LESSEE. <br />13. Reclamation: <br />(a) LESSOR shall have the right to review and approve LESSEE'S reclamation <br />plan prior to submittal, which approval shall not be unreasonably withheld. Upon <br />termination of mining operations or termination of this Agreement, and in accordance with <br />the provisions of any approved reclamation plan and permits issued in connection therewith, <br />LESSEE shall reclaim the areas within the Leased Premises. The parties agree that <br />reclamation can be achieved by covering the completed areas with a "growth medium" which <br />contains enough fines to allow plants to root. This growth medium is not required to be <br />topsoil but shall contain fines or organics. LESSEE shall use its best efforts to locate, obtain <br />and stockpile from other }obsites suitable material for reclamation purposes. In the event <br />such material is not readily available, the parties agree to locate suitable areas on-site where <br />growth medium maybe obtained and used for reclamation <br />(b) LESSEE shall be responsible for side sloping ponds, pits or other extracted <br />areas to conform to reclamation sloping requirements as set forth in approved permits. <br />LESSEE shall line the excavation to industry standards for water storage. <br />(c) When not inconsistent with any mining and reclamation permits and <br />approvals, LESSEE shall provide reasonable cooperation with LESSOR in performing its <br />reclamation work in harmony with the desires of the LESSOR. <br />14. Protection of Premises: LESSEE shall provide and install adequate gates at all <br />entrances into areas ofthe Leased Premises beitrg used or occupied by LESSEE. Such gates will be <br />kept locked during hours of darkness, and at all times when such areas are not occupied by <br />LESSEE'S personnel. <br />09/06/2002 L.G. Evens[ /Rock Island Laud Co.
