Long <br />Division Director <br />Paonia, Colorado 81428 <br />RE: Completeness, TR-39, Coal Refuse on Portal Bench, Bowie No. 1 Mine, Permit No. C- <br />8d-038, Bowie Resources Limited <br />Deaz Mr. Bear: <br />In a letter dated September 18, 2001, the Division explained the reasons for calling TR-3J <br />incomplete. Also in that letter, the Division stated what needed to be submitted in order to call <br />TR-39 complete. The Division would like to add one item to that list for completeness. <br />Since the reclamation of the portal bench will be altered by the inclusion of a coal waste pi10 in <br />the reclamation fill, the Division requires the submittal of an appropriate demonstration that the <br />proposed reclaimed portal bench will be incompliance with the regulations. The requirements of <br />Rule 4.14 must be met, including a minimum factor of safety of 1.3 for backfilled slopes, as <br />required in Rule 4.14.2(1)(b), and the proper disposal of coal in the reclamation fill, as described <br />in Rule 4.14.3.
