Please consider this <br /> letter to be a letter of objection supplementing our initial <br /> letter of objection on this application dated April 17, 1997 . We <br /> are submitting this supplemental letter within five days <br /> following the informal prehearing conference, as your rules <br /> require. <br /> We have two additional objections to make to the amendment <br /> application. First, the amendment application is deficient in <br /> that it does not include the levee embankment (or so-called berm) <br /> which predated the original application for the Deepe Farm Pit, <br /> but has been substantially modified during the permit's term. We <br /> included this objection in our April 17 letter. However, we <br /> learned at the May 6 conference that Western Mobile, following <br /> the submission of the pending amendment, applied for a "technical <br /> revision" to the plan to include certain proposed changes to the <br /> berm. Apparently the DMG staff received the proposed technical <br /> revision on the morning of the May 6 prehearing conference. <br /> Needless to say we are disturbed by this unexpected development. <br /> It appears to us to be an end-run around the amendment process <br /> which we had assumed would be the appropriate forum for <br /> addressing the serious floodplain issues related to the berm. <br /> 1 <br /> Jana L Mendez Ronald K,Stewart Paul Danish <br /> County Commissioner County Commissioner County Commissioner <br />
