Long <br />Division DnrcV,r <br />Reference: Letter, Colowyo Coal Company L.P., September 29, 1997, Re: Colowyo Coal <br />Mine (C-81-019) RN-3 Application Comments Regazding the August I8, 1997 <br />Division Proposed Decision to Approve, Permit Renewal Application No. 3 <br />Deaz Mr. Kiger: <br />Please find enclosed a revised (October 21, 1997) version of the August 18, 1997 Proposed <br />Decision and Findings of Compliance with regazds to Permit Renewal 03. Changes to the <br />August 18, 1997 version were made in response to comments in the referenced letter. <br />Please review the revised Proposed Decision and Findings of Compliance for accuracy in <br />response to your concerns. Changes aze presented and keyed in Paragraph 3.1.3 of the revision <br />(Pages 6 - 10). A worksheet summary of acreages reclaimed is also enclosed. <br />Upon receipt of your concurrence with the changes, the Proposed Decision to renew the Permit <br />will be announced. The additional public review and comment period for re-issLlance of the <br />Proposed Decision will extend the renewal process beyond November 5, 1997. Colowyo Coal <br />Company L.P. will be allowed to continue operations (Colowyo Coal Mine) under the provisions <br />of Rule 2.08.5 Right of Successive Renewal until the new permit is issued (see Pazagraph 3.1.9, <br />Page I5, of the revised Proposed Decision and Findings of Compliance). <br />Portions of Enclosure 1 and Enclosure 2 are being sent via facsimile to you.
