Dept. of Natural Resource° <br />1313 Sherman Street <br />Denver, Colorado 80203 <br />Re: Colorado Yampa Coal Company Permit No. 79-177 <br />Dear Fred: <br />This will confirm our recent telephone conference in <br />which we agreed on the procedure for handling the upcoming revi- <br />sion to Colorado Yampa Coal Company's ("Colorado Yampa") revi- <br />sion to Permit 79-177 to include an underground operation, an3 <br />for coordinating review of that application with the presently <br />pending submission of Colorado Yampa under S.R. 2.01.3(5) ("the <br />state conformity submission"). <br />Specifically, it is our understanding that the Divi- <br />sion will continue to work with Colorado Yampa as expeditiously <br />as possible to complete the review of the state conformity sub- <br />mission. Approval of that submission, together with the prepa- <br />ration of any appropriate findings document will not be delayed <br />pending completion of review for the Foidel Creek underground <br />mine permit revision. We further understand that the findings <br />document for the state conformity submission will focus only on <br />the areas of difference between the state and federal regulatory <br />programs. No independent examination of findings made by OSM or <br />the state in connection with the prior issuance of permit 79-177 <br />will be necessary. <br />While the Division will proceed to issue a written <br />approval and appropriate findings concerning the state conform- <br />ity submission, formal issuance of an appropriate state program <br />permit will be deferred by mutual agreement until the review of <br />the Foidel Creek revision has been completed. By coordinating <br />permit issuance for the conformity submission and the under- <br />ground revision, we can assure that there will be no misunder- <br />standing regarding the permit term for the combined Colorado <br />
