Banta. <br />Drv~Swn D~reotOr <br />Following discussions with Dan Mathews and Fred Banta, the following issues <br />for the Permit Revision are still outstanding, <br />The proposed loadout will need to be handled as a separate permit revision, in <br />order to allow a separate publication and public comment period, pursuant to <br />rule 2.08.4(3) and Section 115 (1)(c) of the Act. This is necessitated by the <br />fact that proper public notice of the proposed location of the facility has <br />not been provided. <br />Since MSHA has indicated that they do not consider the proposed underground <br />waste disposal plan to be approvable, we cannot recommend approval of the plan <br />in our proposed decision. A possible alternative would be to'modify the <br />temporary waste disposal plan to indicate that the disposal would be <br />constructed as a permanent facility. The capacity of the pile would have to <br />be demonstrated to be adequate for the proposed permit term. A11 requirements <br />of Rules 2.05.3(8) and 4.10 apply, including: <br />- diversions must be designed and constructed to convey the 100-year <br />runoff event from the pile itself and to convey upstream runoff away <br />from the pile; <br />- the pile must be constructed in compacted two-foot lifts and must be <br />inspected for stability each calendar quarter by a registered <br />Professional Engineer; <br />- NCEC must demonstrate that four feet of non-toxic cover is available <br />for reclamation of the pile, and final reclamation of the pile must be <br />fully addressed and accounted for in the reclamation cost estimate and <br />the reclamation bond. <br />
