Leach (steve.leach@chevrontexaco.com) <br />Cc: Hernandez, Dan <br />Subject: Permit C-1980-001, Renewal No. 5, Proposed Decision Due Date <br />Dear Mr. Leach, a proposed decision was due on September 16, 2006, on the Permit Renewal Number 5 <br />Application submitted by The Pittsburg and Midway Coal Company (Company). A Division of Reclamation, Mining <br />and Safety (Division) adequacy letter with regard to the application was sent to the Company on June 28, 2006. <br />There were no adequacy issues at that time. At this time, an assessment by the Division is that final reclamation <br />and associated final bond release is not likely this calendar year. This incurs a reconsideration of the adequacy of <br />the Permit Application Package in its present form. This reconsideration is undervvay. Please request an <br />extension of the proposed decision due date until September 29, 2006. In the event that adequacy issues are <br />identified, another extension may be in order so that potential adequacy issues can be resolved.
