Coal ownership is Federal and private. Surface lands ownership is private. OSM is in <br />agreement with [he proposed decision and hereby provides OSM concurrence with the bond <br />release in accordance with 30 CFR 906.30(24). <br />DMG documented it's bond release inspection findings in the proposed decision. The proposed <br />decision also documents the correct filing and advertising of the public notice and landowner <br />notifications. DMG did not receive any comments, objections, or requests for an informal <br />conference regarding the bond release application. The Bureau of Land Management issued a <br />concurrence on the release dated March 13, 2000. <br />This bond release is an acknowledgment that the Edna Mine has me[ the standards for Phase I, II, <br />and III bond release on [he. 13.5 acres identified in the application. DMG holds a current <br />performance bond for $5,042,176 for the entire Edna Mine area. DMG proposes to release <br />$663,590 of the performance bond for this Phase I, II, and lII release.
