Mr. Rick Mills 2 <br />• <br />• Colorado Yampa Coal Company is requesting a reduction in the bond of <br />$6,353,035.00, from the current $10,585,393.00 the Division currently holds. This <br />figure represents an overall reduction of 60% from the original bond amount in <br />accordance with Rule 3.03.1(2)(a). <br />The Division has already released liability of $1,705,393.00 from the $10,585,393.00. <br />By statute, a maximum of 60% of the original bond may be granted release for <br />completion of backfill and grading operations (Phase I Release). The remaining <br />bond held after Phase i Release must equal a minimum of $4,234,157.00, or the cost <br />estimated to complete all remaining reclamation work. Therefore, the monetary <br />amount actually being requested for release would equal $4,645,843.00, not <br />$6,353,035.00 as stated in Colorado Yampa Coal Company's letter dated July 19, <br />1996. <br />• No legal description of the lands being requested for release was included in the <br />bond release package, although a general location map and post-mining topography <br />maps, 48A, Area 60 regraded topo, and Area 61 regraded topo, are included in the <br />package. The Area 60 and Area 61 maps provide a township and range description, <br />Townships S and 4 North, Range 86W. The section numbers on the general location <br />map are indecipherable. Please provide a clear legal description of the lands being <br />requested for bond release. <br />• Post-mining topography maps, 48A, Area 60, and Area 61, have been provided along <br />with cross section maps. A certified copy of Map 48A, as required by Rule 2.10.3(2), <br />is included in the permit. <br />• The bond release application indicates that final grading of area 51 and 61 was <br />completed in 1991. <br />• Communications between the Division :tnd CYCC regarding grading contours have <br />been included with the application. <br />• Copies of notices sent to parties identified in Rule 3.03.2(1) have been included in <br />Appendix B of the bond release application. <br />• A copy of the proposed newspaper advertisement was included in the bond <br />application package. The publication of the public notice initiated on July 25, 1996, <br />ran for four consecutive weeks, with the final publication on August 15, 1996 in <br />accordance with Rule 3.03.2(1)(b). Proof of publication was received by the Division, <br />via fax, on August 25, 1996. <br />
