Further, the risk of revegetation failure will <br />correspondingly decrease over time leaving CMLRD with more than <br />adequate bond to ensure long-term site reclamation success. <br />5. RELEASE OF CONTINUING LIABILITY. <br />In exchange for site reclamation during the 1990 reclamation <br />season, and submission of sufficient bond monies to cover remaining <br />site reclamation contingencies, the Board would release Rockcastle <br />from any continuing site liability. The release would be granted <br />to Rockcastle upon completion of all reclamation activities and <br />engineering studies conceptually described above and definitively <br />set forth in the agreement described below. <br />6. AGREEMENT. <br />The proposal would be set forth in the form of a formal <br />agreement between Rockcastle and CMLRD. The letter agreement would <br />contain a detailed understanding of the respective rights and <br />obligations of Rockcastle and CMLRD under the proposal including <br />an understanding of: (1) the reclamation activities to be <br />conducted onsite; (2) the expedited bond release procedures; (3) <br />the amount of the retained bond; and (4) the release of <br />Rockcastle's continuing liability.
