It is our understanding that CMLRD generally <br />concurred with this proposal. Consequently, Rockcastle is <br />submitting the attached formal proposal for CMLRD's review. <br />Rockcastle also formally requests that we commence detailed <br />negotiations and that this proposal be considered by the Colorado <br />Mined Land Reclamation Board (the "Board") at its May 23-24, 1990 <br />meeting. Approval by the Board at the May meeting is required to <br />assure that onsite activities can commence on June 1, 1990 and be <br />completed in September, 1990. While Rockcastle anticipates that <br />details of the proposal may change before the board meeting due to <br />CMLRD's comments, Rockcastle believes that the concept embodied <br />herein will form the basis for our negotiation culminating in a <br />formal agreement setting forth the details and final resolution of <br />the reclamation and liability issues. <br />Successful completion of the plan requires reclamation <br />activities to begin as soon as possible. To expedite this process, <br />Rockcastle has entered into contract negotiations with Native <br />Excavating ("Native"), and ACZ, Inc. for completion of various <br />aspects of the reclamation proposal. Rockcastle hopes to have <br />executed contracts with both Native and ACZ, Inc. prior to the May <br />board meeting. <br />
