As your <br />division has been previously made aware by communications from <br />the City, the City became the owner of the property as a result <br />of a land exchange with Burlington Northern Railroad, without any <br />knowledge of previous operations on the property by Energy Fuels <br />Mining Company. The City's objective and intent in acquiring the <br />property was to use the land for wastewater disposal for both <br />sludge and effluent. It is currently the City's plan to begin <br />making use of the land in this manner in the near future. <br />Since the City's acquisition of the property, the Colorado <br />Department of Transportation has placed large amounts of topsoil <br />on the property to be used in the final construction phase of the <br />Trinidad Bypass project. This was done with the City's <br />permission. At the time the City granted this permission, it had <br />no knowledge of prior activities by Energy Fuels Mininq Company. <br />It is the City's position that the use of the property for <br />stockpiling of topsoil by the Colorado Department of <br />Transportation constitutes a post-mining land use justifying <br />release of the Energy Fuels Mining Company's bond. The <br />contemplated use of the property as a wastewater disposal site <br />would also constitute a post-mining land use. These uses are <br />consistent with the zoning classification of the land. The land <br />is zoned Growth-Industrial. <br />
