<br />Chips Barry -2- April L1, 1980 <br />In the report, on page G-8, it is stated that during the excavation of gravel, <br />it is possible that increased seepage may result from the Boxelder Ditch. <br />The applicant states that the increased seepage can be determined and that <br />amount will be pumped back into the ditch. The applicant does not state <br />how they will determine this increased seepage rate. It is our recommendation <br />that either weirs or gages should be placed both upstream and downstream of <br />the project at the expense of the applicant so that the loss can be accurately <br />measured, since the applicant is the one responsible for this injury to the <br />owners of the ditch. <br />The applicant also states that several wells may be impacted by the dewater- <br />ing in Sections 33 and 27, however, no means of mitigating these potential <br />injuries was discussed in the report. <br />The applicant failed to analyze the effect of evaporation losses from the <br />reclaimed ponds upon the hydrologic balance and upon senior surface water <br />rights along the Poudre. The removal of the area being mined from irrigation <br />could possibly offset these evaporation losses. Until we receive additional <br />information concerning the historic consumptive use of irrigation water on the <br />property, we cannot adequately evaluate these effects. <br />We cannot recommend approval of this amendment until additional information <br />has been provided concerning a legal, dependable water supply and a plan <br />to "minimize the disturbance to the hydrologic balance" resulting from evapora- <br />tion losses has been approved. <br />Hal D.
