C~ <br />.5. <br />Prehearing Conference. <br />• <br />Members ojthe public wishing to testify at the Formal Public Hearing may submit written <br />and /or oral testimony to the Board during the designated time period for public comment at the <br />hearing. Although only one copy of written testimony is required for non-party witnesses, it is <br />recanrnended that 12 copies be provided to allow jor full consideration by the Board and staff <br />All documents, exhibits and photographs presented as evidence at the Formal Public <br />Hearing will become part of the adminis[rative record. Upon request, a party may recover any <br />evidence introduced by that party, if no action for judicial review is camnenced within thirty (30) <br />days of [he date agency action in this matter becomes effective. <br />VI. PROCEDURE <br />The Division, parties and members of the public shall make presentations in the following <br />order. The time limits set o:rt below are maximum limits and shall be strictly enforced. The Board, <br />in its discretion, n:ay allow additional time when warranted The Board hcrs the right to limit any <br />redundant or irrelevant testimony. At the conclusion of each presentation, and within lime limits <br />set by [he Board, [here will be an opportunity to conduct cross-examination of any witnesses that <br />testified during the presentation. <br />1. The Pre-hearing Conference Officer shall present the Order !o the Bom•d for adoption. <br />2. The Board will hear any objections to the Pre-hearing Order. <br />3. Board 's Consideration and Adoption of the Pre-hearing Order. <br />4. Division's Introduction and Overview: <br />The Division shall have IS minutes in which to present an introductory overvie+v ojthe <br />application. <br />Applicant's Presentation: <br />Snowstorm Sand & Gravel LLC (applicant) shall have 30 minutes in which to make n <br />presentation to the Board. <br />6. Division's Presentation and Recornn:endation: <br />The Division shall have 20 minutes in which to present i!s reconunendcuion !o the Board. <br />
