Canany <br />Division Director <br />Natural Resource Trustee <br />I previously sent you the attached letter and then received a call from Rick Krueger in <br />your office saying consultation would be necessary to assess the potential for the <br />proposed pond to deplete flows in the Colorado River basin. <br />The original design of the pond included a permanent 0.9 acre-foot pool of water in the <br />pond. The mine operator is modifying the pond design so that it does not have a <br />permanent pool of water. The modified design will require the release any pond inflow <br />within 72 hours of the inflow.
