Drawer D <br />Hayden, CO 81639 <br />RE: Seneca II Mine (C-80-005) <br />TR-31; Topsoil Management Plan <br />Dear Mr. Altavilla, <br />The Division of Minerals and Geology received your request to extend the TR-31 decision due <br />date to September 30, 1997. The current due date is set for August 30, 1997. The Division will <br />approve the extension, but we feel that it is important to reiterate our concern that topsoil is <br />currently being replaced in the Auger Area E and the lower Wolf Creek Pit prior to an approved <br />depth. <br />Seneca initiated topsoil replacement in Auger Area E in early July and in the lower Wolf Creek <br />Pit in mid August. Topsoil depths have not been approved in these areas. Auger Area E has <br />been topsoiled to a depth of 6 inches, with the understanding that more topsoil may be <br />required with the approval of TR-31. It also appeazs that this azea is being prepped for <br />revegetation this fall. Seneca should be reminded that the current permit requires a 12-inch <br />replacement depth. The 6-inch replacement depth in Auger Area E has not been approved by the <br />Division, and additional topsoil may be required. This also holds true for the Wolf Creek Pit <br />area currently being topsoiled. <br />The Division would like to see a timely response to the Division's adequacy letter dated July 29, <br />1997. The topsoil deficit issue was first noted in 1995, and then addressed as stipulation 34 to <br />the Seneca [I permit renewal. The Division is concerned that this issued was addressed two years <br />ago, and topsoil is being placed to a particular depth prior to approval of TR-31. <br />
