Mr Dave Stout - 2 - June 14, 1985 <br />Tables 1 and 2 define a revised monitoring plan acceptable to the Division. <br />The last three sites have been revised from the original requirements of <br />Stipulation No. 3 for the Permit Revision No. 1 of the New Elk Mine. <br />The operator should understand that this program is separate from the NPDES <br />requirements and does not negate any requirements of that permit. <br />Wyoming Fuel Company's response to Stipulation No. 9 of the New Elk Mine and <br />Stipulation No. 6 of the Golden Eagle Mine is considered to be a part of the <br />technical revision requesting reduction in monitoring. The Division agrees <br />that a reduction in the monitoring of springs and seeps within the one mile <br />perimeter of the permit boundaries is now warranted. The Division proposes a <br />modification to the company's request for no monitoring to a once a year <br />survey of springs numbered 12 - 19. the Santistevan Flume site has been <br />previously covered. These 8 springs must be surveyed in August of each year, <br />the high flow month in the previously submitted data. <br />Also, Wyoming Fuel should clarify the discrepancy between springs located on <br />the Preliminary Spring-Seep Survey Map submitted in March of 1984 and the map <br />submitted for the Technical Revision. <br />• During the review of the Annual Hydrologic report, the monitoring requirements <br />for Pete Canyon were also reevaluated. The references to Pete Canyon in <br />Stipulations No. 12 and 14 are revised as follows. <br />Stipulation No. 12 <br />PRIOR TO INSTIGATING MINING ACTIVITY WITHIN 400 FEET OF THE DRAINAGE BASIN <br />BOUNDARY OF PETE CANYON, WYOMING FUEL COMPANY MUST SUBMIT A MINIMUM OF ONE <br />YEAR OF BASELINE DATA FROM AN ALLUVIAL WELL IN THE LOWER REACHES OF PETE <br />CANYON. THIS WELL MUST BE MONITORED FOR MONTHLY GROUND WATER LEVELS AND <br />QUARTERLY FIELD PARAMETERS. <br />Stipulation No. 14 <br />PRIOR TO SECONDARY OR RETREAT MINING WITHIN 400 FEET OF THE DRAINAGE BASIN <br />BOUNDARY OF PETE CANYON, THE APPLICANT SHALL PROVIDE A DESCRIPTION OF STREAM <br />FLOW CHARACTERISTICS AND WATER USE IN PETE CANYON. <br />I will be pleased to discuss these requirements with you, should you have any <br />questions.
