<br />
<br />RE: APPROVE .REQUEST TO VACATE A PORTION OF SPECIAL REVIEW PERMIT 11386 AND
<br />CERTIFICATE OF DESIGNATION - COORS ENERGY COMPANY
<br />WHEREAS, the Board of County Commissioners of Weld County, Colorado,
<br />pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
<br />with the authority of administering the affairs of Weld County, Colorado, and`/
<br />WHEREAS, by Resolution dated June 20, 1979, a Special Use Permit for oplfi
<br />cut mining was granted to Adolph Coors Company, and
<br />WHEREAS, by Resolutions dated July 11, 1979, and December 19, 1979, said
<br />Special Use Permit was amended, and
<br />WHEREAS, by Resolutions dated April 15, 1987, an amendment of Use by
<br />Special Review for surface coal mining and ash disposal and a Certificate of
<br />Designation for ash disposal was granted to Coors Energy Company, and
<br />WHEREAS, said Permit and Certificate of Designation were granted for
<br />property described as:
<br />Part of Sections 25, 26, 35, and 36, all in Township 3
<br />North, Range 64 West of the 6th P.M., Weld County,
<br />Colorado
<br />WHEREAS, the Board has been presented with a request from Coors Energy
<br />Company that part of the Permit area be released and vacated from the Certificate
<br />of Designation, as displayed in the plat, a copy of which is attached hereto and
<br />incorporated herein by reference as Exhibit "A", and
<br />WHEREAS, said matter was considered on March 24, 1993, at which time the
<br />Board deemed it advisable to continue said matter to April 7, 1993, at 9:00 a.m,
<br />and
<br />WHEREAS, at said meeting of April 7, 1993, after study and review, the
<br />Board deemed it advisable to approve said vacation of a portion of Special Review
<br />Permit 11386 and Certificate of Designation.
<br />NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
<br />County, Colorado, that the request of Coors Energy Company to vacate a portion
<br />of Special Review Permit 11386 and Certificate of Designation as hereinabove
<br />mentioned be, and hereby is, approved.
