(Energy Fuels) requests approval <br />of Phase I bond release for the Loadout Facility and associated reduction of the performance <br />bond amount. The accompanying bond release application is formatted to effect compliance <br />with applicable provisions of Rule 3.03.2. The accompanying proof of publication of the <br />public notice states Energy Fuel's intent to seek bond release. In addition, a listing of those <br />individuals and entities receiving written notice, and a copy of each notice, are also attached. <br />Energy Fuels completed the reclamation work subject to this request during July through <br />November 1996. Reclamation involved removal from the site of all surface swctures, <br />stockpiled coal and base materials; backfilling; and regrading according to the approved <br />reclamation plan. Site drainage was established according to plans to ensure long-term <br />stability and to minimize off-site impacts. <br />Since Energy Fuels no longer plans to utilize the Loadout Facility, the disturbance area was <br />reclaimed consistent with the approved reclamation plan and landowner wishes. Given the <br />above conditions, Energy Fuels respectfully requests that the DMG release $26,980 from the <br />Southfield bond for backfilling and grading the Loadout. <br />
