Box 15596 <br />Lakewood, Colorado 80215 <br />RE: Minor Revision, Non-Coal Waste Disposal Area <br />New Elk Mine - File No. C-012-81 <br />Dear Mr. Stout: <br />The Division has reviewed the submittal of additional information for the <br />above referenced minor revision. The Division is prepared to approve the <br />• revision, contingent upon the following: <br />1. A more detailed map must be submitted depicting the non-coal refuse <br />area. The northern boundary should be moved to the south side of the <br />berm, so that the drainage is not included in the area. The <br />evaporation pond, berm, topsoil borrow area, plugged well, and refuse <br />disposal area should all be shown on this map. <br />2. The intention of the Division was to permit this area as a solid waste <br />disposal area. As such, the disposal of paint, lubricants, grease and <br />f]ammable liquids would not be allowed. Disposal of such items would <br />require compliance with EPA hazardous waste regulations. Without such <br />compliance, the Division would stipulate that these materials may not <br />be disposed of in this area. <br />3.
