C-81-071 <br />Introduction: <br />A coal operator must submit a revision to the Mined Land Reclamation <br />Division to leave an impoundment at a site on a permanent basis, Seven <br />criteria must be met from Rule 4,05.9(1). This document outlines ' <br />compliance with all seven criteria, and is submitted to the file to <br />compensate for the brevity of the technical revision and to present a <br />rationalization for the decision which was made. The staff felt a <br />detailed review was necessary in light of the marginal water quality and <br />the size of the impoundment (210 acre feet). <br />The post-mining land use of the impoundment is stock-watering and fish <br />and wildlife habitat. Water quality of the impoundment is unsuitable for <br />irrigation purposes. <br />4,05,9(1) Permanent impoundments for beneficial use of stored <br />water may only be authorized in accordance with applicable state <br />law and upon the basis of the following demonstration: <br />(a) The quality of the impounded water shall be suitable <br />on a permanent hasis for its intended use, and discharge of water <br />from the impoundment shall not degrade the quality of receiving <br />waters to less than the water-quality standards established <br />pursuant to applicable State and Federal laws; <br />The water discharging from Pond A, sampled at Site 39, is a slightly. <br />alkaline, calcium sulfate water, with an average hardness exceeding 465 <br />mg/1, Several parameters periodically exceed water quality standards, <br />and each will be discussed individually, <br />The water occasionally exceeds irrigation standards for molybdenum, but a <br />review of the data showed that poor detection limits were at fault. <br />423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203-2273 Tel.
