April 10, 2003 <br />RN-04 <br />Item 3. With regard to Paragraph 10, Affected area, page 3, of the Application, please revise the <br />Application under the following guidance. Affected areas are defined as azeas undermined, <br />areas within the zone of the angle of draw of potential subsidence, and areas disturbed by surface <br />activities of the mining operation. <br />a. Under Permitted, enter the sum of (1) the acreage of the areas permitted to be <br />undermined in the 5-year mining plan, (2) the azea described at the surface by <br />intersection of the angle of draw, and (3) the azea of surface permitted to be disturbed <br />from surface activities outside the area of (l)and (2). The entered value of 1565 may <br />be correct. The permitted area extent of parameters (1) and (2) may be determined off <br />Drawing No. D-4-1 (dashed boundary line). To this would be the areas of additional <br />permitted surface disturbance, once identified as 129 acres. The copy of Drawing D-4- <br />1 on file with the Division in the Permit Application Package (PAP) is dated 2/9/81. <br />See Item 7 below. <br />b. Under Actual, enter the sum of (1) the area (acres) actually undermined, (2) the acres <br />of the area described at the surface by the intersection of the angle of draw from the <br />actual area undermined and (3) the azea of surface disturbance from surface activities <br />outside the area of (l)and (2) (avoid double counting as above for Permitted area). <br />Although not so legended, the areas actually mined might be that shaded on Map D-30- <br />20 (11/99). In addition, mine inflow maps are on file at the Division. The version on <br />file includes inflows of 6/84, and was received at the Division on January 9, 1986. The <br />base of this map on file at the Colorado Geologic Survey, but not part of the PAP, is <br />dated 12/4/82, but the advance of longwall mining is dated Februazy 18, 1983. The <br />notice of temporary cessation at Mine No. 3 was provided by letter of December I5, <br />1982. This mine was to be idled on December 17, 1982. This letter stated 2.4 acres of <br />affected surface azea at Mine No. 3. Notice of temporazy cessation for the Number 1 <br />Mine was provided by a letter of July 31, 1984, which stated that all mining ceased as <br />of July 24, 1984. No figure of affected area was provided. <br />c. Leave "Proposed" blank. <br />Item 4. With regard to Paragraph 11, Disturbed area, page 3 of the Application, please change <br />43.5 acres under Actual to read 65.2. <br />Item 5. With regard to Pazagraph 13, on page 3 of the Application, under Actual, please change <br />the 43.3 acre entry for A. 60 percent to read 65.2; change the 43.3 acre entry for B. 85 <br />percent to read 65.2; and change the 0 acre entry for C. 100 percent to read 2. <br />Item 6. With regard to Paragraph 17 of the Application, on page 4, please change Ol to read 0. <br />Item 7. Please provide the exact number of surface acres affected in the permit area at the <br />time of (permanent) cessation [Rule 4.30.1(2)(a)]. Such information might be appropriate to a <br />
