Weeds
were also the subject of your letters of September 8 and September 12, 1997. We have
conducted a comprehensive review with regazd to the bond under consideration for Phase II/III
• release (Bond Number JP-0942, $184,071.00) associated with reclamation activities df Enron
Coal Company at the Northern #1 Mine, Permit Number C-81-032). The Permit and bond seem
to apply only to the mining activities at the mine, not exploration activities, and the bond amount
retained applies only to reclamation of the disturbed azeas to revegetation standazds.
A summary of references concerning roads is at Enclosure 1. All references to roads and their
reclamation (or retention as permanent features) apply to the haul roads associated with the mine
portals, support azeas, and the development waste azea. No objections were found in the files to
the Phase I (backfilling and grading, circa 1987) portion of the bond release process. If you
recall filing an objection at that time, please provide me with a copy. Such a filing would have
likely been in response to a Mined Land Reclamation Division letter of September 15, 1987, Re:
Bond Release Request, Meeker Area Mines C-81-032.
[n summary, the permit (C-81-032) files and the bond held by the Division of Minerals and
Geology (Division) do not seem to address the roads other than the haul roads (which have been
approved to remain as permanent features)
As exploration roads (and their reclamation) would most likely be a subject within the Division's
"Notice of Intent" permitting process for coal exploration activities, these records too were
checked. The Division still holds a reclamation bond in the amount of $25,000.00 for
exploration activities conducted on your properties as well as other properties. Within this file
• was found a statement of yours, dated May 11, 1981, that "... the reclamation work done on the
~/6
.~
