<br />City of Golden <br />83Cw361 <br />L~ <br />C~ <br /> <br />d. The daily amount of sewage delivered to the <br />Coors/Golden wastewater treatment plant; <br />e. The daily measurement of the heights of the Golden <br />Reservoirs and the daily quantity of water in the reservoirs; the <br />quantity of water stored in priority during the day; the quantity <br />of water stored by exchange or directly under the Augmentation <br />Water Rights, and the amount of evaporation during that day. The <br />seepage shall be compensated for on a continual basis by the <br />storage of additional water (to compensate for seepage of <br />transmountain and nontributary water out of the reservoir) or by <br />the release of water (to compensate for out-of-priority seepage <br />into the reservoir). <br />Golden, upon written request, will provide objectors with <br />copies of such accounting, provided that the requesting objector <br />shall reimburse the Golden for any copying and mailing costs <br />reasonably incurred. <br />16. Retained Jurisdiction. In order to assure that the <br />vested water rights and decreed conditional rights of others are <br />not injured by the change of water rights provided for herein or <br />by implementation of the subject plan for augmentation and <br />exchange, the Court retains jurisdiction in this matter and upon <br />proper petition the Court will reconsider its approval of the <br />change of water rights and the plan for augmentation and <br />exchange. In the event Golden or any person or party petitions <br />the Court for reconsideration of any of the changes or elements <br />of the plan, the Court shall order appropriate notice to be given <br />to all the parties hereto. Such petition shall be made in good <br />faith, under oath, and shall set forth with particularity the <br />factual basis upon which the requested reconsideration is <br />premised, together with proposed decretal language to effect the <br />petition. The party lodging the petition shall have the burden <br />of going forward to establish the rp ima facie facts alleged in <br />the petition. <br />77. Period of Retained Jurisdiction. The Court determines <br />that a period o ive years will su fice in order to determine <br />whether injury is in fact precluded or needs to be further <br />remedied. The five-year period of retained jurisdiction shall <br />begin to run on the date of this decree; provided, however, with <br />respect to issues relating to the operation of the Golden <br />Reservoirs, such period of retained jurisdiction shall extend for <br />a period oP three years from the date each reservoir is built and <br />operational. If no petition for reconsideration is filed within <br />five years from the date of this decree (or the applicable three <br />years in the case of the Golden Reservoirs), the retention of <br />jurisdiction for this purpose shall automatically expire.
