<br />City of Golden <br />83CW361 <br />. 8. Depletions. Depletions resulting from the out-of- <br />priority diversion and use of the Golden Water Works First <br />Enlargement shall be the difference between out-of-priority <br />diversions from Clear Creek under the Golden Water Works First <br />Enlargement (all of which will be metered) and return flows to <br />the Clear Creek/South Platte River system after use. Only the <br />portion of the return flows attributable to the out-of-priority <br />diversion and use of the Golden Water Works First Enlargement <br />shall be included in the determination of depletions to be <br />replaced pursuant to this augmentation plan. Return flows shall <br />include sewage effluent discharged into Clear Creek from the <br />Golden/Coors wastewater treatment plant, to the limited extent <br />provided for in paragraph 9.c. below and subject to the <br />Supplemental Findings and Decree, and irrigation return flows <br />from lawns, gardens, parklands and other irrigated areas within <br />the Clear Creek Basin supplied by Golden's municipal water <br />system. In addition, return flows include that portion of <br />Golden's sewage delivered to the Metropolitan Denver Sewage <br />Treatment Plant which is used to meet winter return flow <br />obligations on the South Platte River pursuant to paragraph <br />6.a.(S)(ii) above. <br />9. Non-Irrigation Depletion Criteria. So as to assure the <br />replacement of out-of-priority depletions resulting from in- <br />house, non-irrigation use of the Golden Water Works First <br />Enlargement, the following criteria shall be employed: <br />a. For the months of December through February, in- <br />house, non-irrigation water use shall be the metered water <br />production measured daily. In-house, non-irrigation water use <br />for March through November of a given year shall be assumed to be <br />constant throughout the year and shall be calculated in March of <br />each year based on the average water production of the Golden <br />water treatment plant for the preceding December, January, and <br />February. Any increase in water production during March through <br />November shall be considered to be attributable to irrigation <br />uses. <br />b. Five percent of such in-house, non-irrigation use <br />will be consumed, with the remainder (954) returning to the Clear <br />Creek/South Platte River system as treated effluent. Therefore, <br />return flows attributable to in-house, non-irrigation use of out- <br />of-priority diversions under the Golden Water Works First <br />Enlargement shall be the lesser of 954 of such in-house, non- <br />irrigation, out-of-priority diversions or the amount of sewage <br />measured at the point of delivery to the Coors/Golden Wastewater <br />Treatment Plant. The result shall be multiplied by the ratio of <br />Golden's Clear Creek sewage to total sewage (including sewage <br />delivered to Metro). <br /> <br />-10- <br />
