Lessee shall comply with all applicable local, state <br />anc, federal laws, specifically Colorado Mined Land Reclamation <br />Act., Colorado Revised Statutes 34-32-101, et seq. <br />PROTECTION AND RESTORATION OF SURFACE <br />9. In digging pits for the purpose of producing and <br />removing materials, Lessee agrees to make separate stockpiles of <br />topsoil and of waste substances. Lessee agrees that on comple- <br />tion of the removal of materials from pits that have been dug on <br />the. leased premises, Lessee will fulfill all of the restoration <br />reeuirements as set forth in the Colorado Mined Land Reclamation <br />Act., C.R.S. 34-32-101, and .regulations pursuant thereto. <br />INDEMNIFICATION OF LESSOR <br />10. Lessee agrees to indemnify Lessor against liability on <br />al]. claims for damages and injuries to persons or property that <br />• are. claimed to have resulted from the activities or omissions of <br />Leesee or its agents or employees during the term hereof. <br />DEFAULT BY LESSEE <br />11. In the event any default occurs in the performance of <br />any term or condition of this lease by Leesee, Lessor shall have <br />the right to give a ten-day notice in writing to Lessee, demand- <br />in~. the correction or removal of such default. In the event <br />Lessee fails to correct or remove such default within such <br />period, Lessor may, at his option, terminate this lease. If this <br />les.se is terminated by Lessor pursuant to this section, Lessor <br />shs.ll have no further rights or remedies against Lessee except <br />the forfeiture of this lease. Lessee shall have thirty (30) days <br />after such termination within which to remove any plant, struc- <br />tures, or equipment placed on the leased premises by Lessee. <br />BINDING <br />12. This lease agreement shall be binding upon the heirs, <br />successors and assigns of the respective parties. <br />• <br />-3- <br />
