<br />YHEREAS, Morgen,County desirsa to coaduet a(n) open pit mining
<br />operation, knows u Green Pit for the purpose of sxergecing open pit
<br />mimed sand 6 gravel and
<br />WHEREAS, on May 15 ~ , 19 78 , Morgan County "FILED" an appli-
<br />aition, a reclamation plan and map, and the required fee, a. required by law; and
<br />WHEREAS, on ,Tune 29 , 19 78 , the Mined Land Reclamation Board approved
<br />Morgan County~e application and set bond; and
<br />WHERe:AS, on June 29 , 1978 , the Mined Land Re [lama[ ion Boazd accepted surety
<br />s4~mlttad by Morgan County and Euch date shall be considered the
<br />dote of issuance of the permit and the anniversary date for all other purposes; and
<br />WHEREAS, the Mined Lend Reclamation Board has made a tiadiag, for the purposes
<br />of issuing thi^ permit, chat:
<br />1) the application ewpliea with the requirements of the Colorado
<br />Mined Land Reclamation Act and all applicable local, ^tate and
<br />Federal lava; and,
<br />• 2) the apsration will not adversely affect the stability of any
<br />eignitieant, valuable, and permanent man-made structures located
<br />within two hundred feet of the affected land, except where there
<br />Sa an agrssment between the operator and the persona having an
<br />• interest in the etsueture that damage to the structure le to ba
<br />compensated for by the operator; and,
<br />• 3) the proposed mining operations and reclamation can be carried out
<br />in con[ormance with the requirements of C.R.S. 1973, 34-32-116,
<br />ae amand~d (1976 Saaa. Lwa H.B. 1065); and
<br />WHEREAS, for the purposes of issuing thin permit, the operator has made
<br />,~ aatiefaetory eh wing to the Board that he will employ during and after his
<br />open pit mining aperationa procedures reasonably designed to minimize as m~
<br />,ta practicable the aieruption from the open pit mining operations and vlt:
