.~ <br />PART I. AUTHORIZATION TO CONSTRUCT AND INJECT <br />Pursuant to the Underground Injection Control Regulations of <br />the U. S. Environmental Protection Agency codified at Title 40 of <br />the Code of Federal Regulations, Parts 124, 144, 146, and 147, <br />Industrial Resources, Incorporated <br />Z15 Union Boulevard <br />Suite 601 <br />Lakewood, Colorado 80228 <br />is hereby authorized. to construct and operate the Class III <br />facility to be known as the Nahcolite Solution Mine, located in <br />Township 1 South, Range 98 West, in Sections 15, 16, 17, 21, 22, <br />23, 25, 26, 27, and 28 in Rio Blanco County, Colorado. Injection <br />shall be for the purpose of extracting nahcolite (a carbonate <br />mineral), via a solution mining process employing both injection <br />and production wells;, in accordance with conditions set forth <br />herein. <br />Injection activities shall not commence until the operator <br />has fulfilled all applicable conditions of this permit and has <br />received written authorization from the Director. "Prior to <br />Commencing Injection" and "Concurrent with Commencement of <br />Injection" requirements are set forth in Part II, Section C. 2. <br />and 3., respectively, of this permit. <br />All conditions set forth herein refer to Title 90 Parts 124, <br />144, 146, and 147 of the Code of Federal Regulations and are <br />regulations that area in effect on the date that this permit <br />becomes effective. <br />This permit consists of a total of 61 pages and includes all <br />items listed in the Table of Contents. Further, it is based upon <br />representations made by the permittee and on other information <br />contained in the adrtiinistrative record. <br />This permit, and the authorization to inject, is issued for <br />the operational life: of the project, unless terminated (Part III, <br />Section B), or except upon automatic expiration due to prolonged <br />postponement of construction (Part II, Section A. 7. ). The <br />permit will be reviewed annually to determine whether action <br />under 40 CFR 144.36 (a) is warranted, and will expire two (2) <br />years after the effective date of the permit if the facility is <br />not constructed within this two (2) year period.
