<br />Pursuant to Title 34, Article 35, Paragraph 3, of the Colorado Revised
<br />Statutes, the Division of Minerals and Geology hereby issues notice that on
<br />April 27, 1994, a technical revision application for a permit to conduct coal
<br />mining operations by Basin Resources, Inc., 14300 Highway 12, Weston,
<br />Colorado 81091, was deemed complete for the purposes of filing. All reviews
<br />and comment periods as provided in the Act and Regulations promulgated
<br />thereunder initiate from this day of filing.
<br />The applicant pioposes to revise underground coal mining operations at the New
<br />Elk Mine. The technical revision addresses remediation of a diesel spill
<br />which occurred from an underground storage tank located near the Industrial
<br />Building at the East Portal surface facilities. The tank has been out of
<br />service for some time and was removed in December 1993. Testing has indicated
<br />that diesel hydrocarbons remain in the subsoils.
<br />The New Elk Mine permit area is located approximately 25 miles west of
<br />Trinidad, Colorado, in the following sections:
<br />Sections 13, 14, 21, 22, 23,
<br />and 36 of Township 33 South,
<br />and 2 of Township 34 South,
<br />and 31 of Township 33 South,
<br />of Township 34 South, Range
<br />24, 25, 26, 27, 28, 34, 35
<br />Range 68 West; Sections 1
<br />Range 68 West; Sections 30
<br />Range 67 West; and Section 6
<br />67 West.
<br />All sections are partially or fully projected by Basin Resources
<br />due to the unsurveyed nature of the Maxwell Land Grant.
<br />The above-mentioned tracts of land are shown on the USGS 7.5 minute Quadrangle
<br />maps of Vigil, Tercio and Stonewall.
<br />A copy of the technical revision application is
<br />inspection at the Las Animas County Courthouse,
<br />Room 104, Trinidad, Colorado. Written comments
<br />additional information may be obtained from the
