YANAOEMENT <br />RECEIVED <br />DEC 11 1000 <br />Division of Minerals 8 Geology <br />Re: Bowie Resources Limited <br />Bowie No. 2 Mine <br />Telephone Conference Confirmation <br />Dear Mr. Hancock: <br />In order to clarify and notify other parties wncemed with the Construction Permits (Air Permits) <br />of the Bowie No. 2 Mine, I would like to state for clarification the understanding, gained through <br />our telephone conversations, of the situation concerning the construction and use of a truck <br />loadout at the new coal stockpile area at the Bowie No. 2 Mine. <br />I was recently contacted by phone by Mr. Wm. A. Bear (Bill Bear), Manager of Operations - <br />Support for Bowie Resources Limited, while he was in a meeting with Mr. Joseph Dudash, <br />Environmental Protection Specialist for the Division of Minerals and Geology. The question <br />posed to me was to define Bowie's ability to install a temporary truck loading facility at the new <br />coal stockpile area. It was my immediate assumption, because the 96DL103~t construction <br />permit was recently cancelled by the operator, that there was no provision to install a truck <br />loading facility on that pad. After further review and consultations with you, I find and you <br />agree that my assumption was wrong. Bowie does have air permits in place allowing the <br />construction of a truck loading facility at the new coal stockpile. <br />I have confirmed with you by phone, after a review of the recent permit actions concerning the <br />fugitive dust permit, 96DL103-7F, that a truck loadout, the roadway loop, and all other <br />conveyors and structures concerning the downhill conveyor system have been included in the <br />calculations and modeling for pollutant emissions during the approval process of the current <br />permit limitations. <br />Additionally, a truck loadout is depicted on the mine permit drawing FS-1. No additional <br />disturbance is necessary to install this truck loadout. <br />I have also confirmed with you that as long as coal is not hauled further than 1.9 miles, the haul <br />roads are paved, and all other permit limitations are met, then Bowie will be in compliance with <br />the fugitive dust permit. <br />
