In the <br />attachment, Steven M. Maly, a registered professional engineer with W.W. Wheeler and Associates, <br />certifies that the new facilities have been constructed in general conformance with the original design <br />plans and specifications, and that the start-up, testing, and de-bugging process is set to begin. <br />The certification provided meets the requirements of Rule 7.3 of the Mineral Rules and Regulations of <br />the Mined Land Reclamation Boazd. In accordance with Rules 7.3.1(5) and 7.3.2(3), the Division of <br />Minerals and Geology (DMG) hereby accepts the certification of the Mill Water Barge System. With <br />this acceptance, Henderson may put the new facilities into service. As a condition of this acceptance, a <br />copy of the final project report including as-builts and all testing data must be provided to DMG before <br />June 1, 2006.
