,, NOTICE OF PROPOSED DECISION The Colorado Division of Minerals and Geology proposes to approve Technical Revision Application No. 9 (TR-9) for the Bowie No. 2 Mine (Permit No. C-96-083), submitted by Bowie Resources Limited. Approval of this technical revision would allow an incidental boundary change and allow development mining in federal coal. Bowie Resources has secured the federal right of way for development mining only in the federal coal. The incidental boundary change would add 59 acres of private surface and 20 acres of federal surface to the northwest corner of the permit area. The entire 79 acre proposed addition is federal coal. There would not be any change in the conventional room and pillar mining method employed nor would there be any increase in the production rate. The Bowie No. 2 Mine is an underground coal mine located in Delta County, approximately 5 miles northeast of Paonia, Colorado. Coal interest is private, and the surface affected is private land. The permit area encompasses approximately 2,327.0 acres. This proposed decision is based on a finding that the proposed operation will comply with all requirements of the Colorado Surface Coal Mining Reclamation Act, Section 34-33-101, et seq., C.R.S., and the regulations promulgated thereunder. Copies of the proposed decision, including stipulations, are on file for public inspection at the Colorado Division of Minerals and Geology, Room 215, Centennial Building, 1313 Sherman Street, Denver, Colorado 80203. Persons with an interest that may be adversely affected by the proposed decision may request a formal hearing before the Mined Land Reclamation Board on the proposed decision. Such request must be made within ten (10) days of the initial publication of this notice, must be in writing, and must state with reasonable specificity the reasons for the request and the objections [o the proposed decision.
