The NOV was issued in Mazch 1998 for failure to adequately treat surface runoff, <br />failure to maintain adequate freeboard of a sediment pond embankment, and failure to <br />provide a pond discharge structure which safely passes storm runoff. The permittee abated <br />the NOV, paid a $500 fine, and the Divisibn terminated the NOV. <br />Permit Stipulations <br />Prior to the current Midterm Review the permit application had the following three active <br />Permit Stipulations: ST-10, ST-12, and ST-16. The first two of these, ST-10 and ST-16, <br />were withdrawn on November 6, 2000 because they duplicate requirements in the permit. <br />The post-mining topography map (annual reclamation map) required by ST-10 is a permit <br />requirement in section 3.5.3 of the permit. The monitoring of the Lux well required by ST- <br />12 is a permit requirement in section 4.8.5.2 of the permit. The only remaining active <br />Stipulation is ST-16. It requires the pemuttee to submit information regarding anout-of- <br />state violation issued to a corporate affiliate. Part III, below, further addresses ST-16. <br />Additional Midterm Review Items <br />The attached "Checklist of Additional Midterm Review Items" summarizes the results of the <br />Division's review of items that have no specific requirement in the Regulations requiring <br />their review. <br />Trapper Mine Page 5 November 6, 2000 <br />Midterm Review <br />
